Article 1 (Purpose)
The purpose of these Terms of Use is to set forth the rights, obligations, responsibilities, and other necessary matters between the National Institute for Lifelong Education (hereinafter referred to as “NILE”) and users in connection with the use of the K-MOOC website and related services operated by NILE (hereinafter referred to as “K-MOOC”).
Article 2 (Definitions)
The terms used in these Terms of Use shall have the following meanings:
1. “Service” means courses, learning activities, assessments, course completion, membership management, and other related services provided through K-MOOC.
2. “User” means any person who accesses K-MOOC and uses the Service, regardless of whether the person has registered as a Member.
3. “Member” means a person who agrees to these Terms of Use, registers with K-MOOC, and uses the Service.
4. “Course Provider” means a university, institution, organization, or other entity that establishes, provides, or operates courses on K-MOOC.
5. “External Service” means an external identity verification, authentication, login, information, learning, or other service linked to K-MOOC.
6. “Post” means any writing, comment, question, answer, file, image, or other information posted, registered, or transmitted by a User while using the Service.
Article 3 (Effectiveness and Amendment of the Terms of Use)
① These Terms of Use shall become effective when they are posted on K-MOOC or otherwise communicated to Users.
② NILE may amend these Terms of Use to the extent that such amendments do not violate applicable laws and regulations.
③ If NILE amends these Terms of Use, it shall notify Members in advance of the amendments, their effective date, and other relevant matters. However, where advance notice is impracticable due to the enactment or amendment of applicable laws and regulations, urgent security measures, or other unavoidable circumstances, NILE may provide notice after the fact.
④ Where NILE, when notifying Members of amended Terms of Use, clearly informs them that they will be deemed to have agreed to the amended Terms of Use unless they express an objection within a specified period, a Member who does not express an objection within such period and continues to use the Service shall be deemed to have agreed to the amended Terms of Use. However, where separate consent is required under applicable laws and regulations, such laws and regulations shall apply.
⑤ A Member who does not agree to the amended Terms of Use may discontinue use of the Service and terminate the service agreement.
⑥ Matters not provided for in these Terms of Use shall be governed by applicable laws and regulations, and NILE may separately establish and provide guidance on detailed matters necessary for the use of the Service.
Article 4 (Membership Registration and Service Agreement)
① A service agreement shall be formed when a User applies for membership in accordance with the procedures prescribed by NILE and NILE accepts the application.
② NILE may refuse membership registration or restrict the use of the Service in any of the following circumstances:
1. Where another person’s information has been misappropriated or false information has been used
2. Where an application is made for the purpose of interfering with the normal operation of the Service
3. Where an application is made for a purpose that violates applicable laws and regulations or these Terms of Use
4. Where the requirements necessary for use of the Service or an individual service have not been satisfied
5. Where there are other reasonable grounds for determining that acceptance would be inappropriate for the safe and normal operation of the Service
③ Members shall provide accurate information necessary for membership registration and use of the Service and shall update such information when it changes.
④ NILE shall not be liable for any disadvantage resulting from a Member’s provision of false information or failure to update changed information, unless such disadvantage is attributable to NILE.
⑤ Where necessary to provide an individual service or verify eligibility for use, NILE may request additional information or verification to the extent permitted by applicable laws and regulations.
Article 5 (Account Management)
① Members shall manage their accounts and authentication information with the due care of a good manager and shall not transfer or lend them to any third party or permit any third party to use them.
② A Member who becomes aware that his or her account has been misappropriated or improperly used shall immediately notify NILE.
③ A Member shall be responsible for damages and liabilities arising from a breach of the obligation to manage the Member’s account due to the Member’s intentional misconduct or negligence. This shall not apply where such damages or liabilities are attributable to NILE.
Article 6 (Integration with External Services)
① For User convenience and integration between services, NILE may provide identity verification, authentication, login, account linking, or other integration functions through External Services.
② Use of and integration with External Services may be subject to the terms and conditions of the relevant External Service or to separate guidance.
③ Personal information processed in connection with integration with External Services shall be handled in accordance with applicable laws and regulations and the K-MOOC Privacy Policy.
④ NILE shall not be liable for any matter arising from a failure, modification, suspension, or termination of an External Service, or from any other circumstance attributable to the External Service provider, unless such matter is attributable to NILE.
Article 7 (Provision of the Service)
① NILE provides Users with courses and learning-related services through K-MOOC.
② Matters relating to enrollment, assessment, course completion, and other aspects of individual courses shall be governed by applicable laws and regulations, the K-MOOC operating standards, and the standards established for the relevant course.
③ In principle, matters relating to the educational content, learning activities, assessment questions, assessment criteria, and operation of individual courses shall be managed under the responsibility and authority of the relevant Course Provider. However, NILE may take measures as required by applicable laws and regulations or the K-MOOC operating standards, or as necessary for the safe and normal operation of the Service.
④ Enrollment in or completion of a course alone does not confer academic credits, a degree, a qualification, or the status of a student or member of the relevant Course Provider. However, where recognition is granted pursuant to applicable laws and regulations, a separate scheme, or standards established by the Course Provider, such provisions shall apply.
Article 8 (Modification, Suspension, and Termination of the Service)
① NILE may modify, suspend, or terminate all or part of the Service in any of the following circumstances:
1. Where an event of force majeure occurs, such as a natural disaster or national emergency
2. Where information and communications facilities require maintenance, inspection, or replacement, or where a failure occurs
3. Where electricity, telecommunications, or an External Service experiences a failure
4. Where normal provision of the Service becomes difficult due to a sudden increase in Service usage or similar circumstances
5. Where measures are necessary to protect the Service, including the prevention of or response to a security incident
6. Where modification, suspension, or termination of the Service is necessary pursuant to applicable laws and regulations, government policies, or lawful measures taken by an administrative authority
7. Where there are other operational, technical, or policy reasons that make normal provision of the Service difficult or otherwise require modification, suspension, or termination of the Service
② Where a modification, suspension, or termination that materially affects the use of the Service is scheduled, NILE shall notify Users in advance. However, where urgent circumstances or other unavoidable reasons make advance notice impracticable, NILE may provide notice after the fact.
Article 9 (Obligations of Users)
① Users shall comply with applicable laws and regulations, these Terms of Use, and any instructions provided in connection with use of the Service.
② Users shall not engage in any of the following conduct:
1. Misappropriating another person’s information or improperly using another Member’s account
2. Interfering with the normal use of the Service or learning activities of another User
3. Infringing the intellectual property rights, reputation, personal information, or other rights of NILE, a Course Provider, another User, or a third party
4. Harassing, threatening, repeatedly contacting, or otherwise materially interfering with another User’s normal use of the Service
5. Posting or transmitting illegal information, malicious software, or information that may interfere with the operation of the Service
6. Using the Service, without NILE’s authorization, for advertising, promotion, sales, commercial activities, spam, or similar activities
7. Using automated means or similar methods to access the Service or collect information beyond the scope of normal use in a manner that interferes with the operation or security of the Service
8. Improperly circumventing or disabling access controls, authentication, usage restrictions, or other measures designed to protect the Service
9. Taking a course on behalf of another person, taking an examination on behalf of another person, using unauthorized materials, or engaging in other comparable conduct that undermines the fairness of course assessments or completion requirements
10. Engaging in any other conduct that violates applicable laws and regulations or these Terms of Use
③ Where damage is caused to NILE or a third party as a result of a User’s intentional or negligent violation of these Terms of Use, the User shall be liable for such damage in accordance with applicable laws and regulations.
Article 10 (Restrictions on Use, etc.)
① Where a User violates applicable laws and regulations or these Terms of Use, or where necessary for the safe and normal operation of the Service, NILE may restrict all or part of the User’s use of the Service and may terminate the service agreement with a Member.
② Where a Member no longer satisfies the requirements necessary for membership registration or use of the Service, or fails to provide information or verification required for use of the Service, NILE may restrict use of the relevant Service.
③ Where a restriction on use or termination of the service agreement materially affects a Member, NILE shall notify the Member of the reasons for and details of such measure. However, where urgent security measures, prevention of further damage, preservation of evidence, or other circumstances make it difficult to achieve the purpose of the measure through advance notice, NILE may first take necessary measures and notify the Member thereafter. Notice may be omitted where notification is practically impossible, such as where the Member’s contact information is unavailable.
④ A Member may raise an objection to a restriction on use or termination of the service agreement through the call center or by another method designated by NILE.
⑤ The filing of an objection under Paragraph 4 does not by itself suspend the effectiveness of a restriction on use or termination of the service agreement. However, where NILE deems it necessary, it may temporarily suspend the implementation of all or part of the relevant measure.
⑥ Where verification of misconduct relating to assessment or course completion is necessary, NILE or the Course Provider may temporarily withhold finalization of assessment or completion results or issuance of a certificate of completion.
⑦ Where misconduct is confirmed, NILE or the Course Provider may take necessary measures in accordance with the standards of the relevant course, including restricting or cancelling assessment or completion results or revoking a certificate of completion.
Article 11 (Content, Posts, and Intellectual Property Rights)
① Copyrights and other intellectual property rights relating to courses, materials, and other content provided through K-MOOC shall belong to the respective rights holders.
② Users shall use courses and other content in accordance with the terms of use established by the relevant rights holder and shall not reproduce, distribute, transmit, modify, or otherwise use such content beyond the permitted scope.
③ Rights relating to Posts posted by a Member on the Service shall belong to the Member or the lawful rights holder.
④ Members shall not infringe the rights of any third party when creating or using Posts and shall be responsible for any infringement caused by their intentional misconduct or negligence.
⑤ Where a third party asserts a claim, brings a lawsuit, or otherwise initiates a dispute against NILE due to a Member’s intentional or negligent violation of these Terms of Use or infringement of rights, and NILE suffers damage as a result, the Member shall be liable for such damage in accordance with applicable laws and regulations.
⑥ NILE may reproduce, transmit, store, or convert the format of Posts to the extent necessary for the provision, operation, and improvement of the Service and purposes incidental thereto.
⑦ NILE may restrict the posting of or delete Posts, or take other necessary measures, where a Post falls under any of the following:
1. A Post that violates applicable laws and regulations or these Terms of Use
2. A Post that infringes a third party’s intellectual property rights, personal information, reputation, or other rights
3. A Post containing illegal information, malicious software, or material that threatens the security of the Service
4. Advertising, promotion, commercial solicitation, spam, repetitive posting, or similar content that is inconsistent with the purpose of the Service or interferes with normal use
5. A Post that harasses, defames, or threatens another User or interferes with learning activities
6. A Post that undermines the fairness of assessment or course completion or encourages academic misconduct
7. Any other Post that materially interferes with the normal operation of the Service
⑧ Except where otherwise provided by applicable laws and regulations, NILE shall have no obligation to continuously monitor or pre-screen all Posts made by Users.
Article 12 (Protection of Personal Information)
① NILE shall protect Users’ personal information in accordance with applicable laws and regulations.
② Specific matters concerning the purposes of processing personal information, categories of personal information processed, retention periods, provision to third parties, entrustment of personal information processing, integration with External Services, and the rights of data subjects shall be governed by the K-MOOC Privacy Policy.
③ Where separate consent is required for the processing of personal information under applicable laws and regulations, such consent shall be obtained in accordance with the required procedures.
Article 13 (Request for Transmission of Personal Information and Use of Automated Tools)
① A data subject, or a representative authorized by the data subject in accordance with applicable laws and regulations, may request the transmission of the data subject’s personal information in accordance with the Personal Information Protection Act and other applicable laws and regulations.
② Where a representative authorized by the data subject uses an automated tool to receive transmitted personal information, such representative shall follow the methods and procedures agreed upon in advance with NILE in accordance with applicable laws and regulations.
③ Where automated access, collection, or transmission that does not comply with applicable laws and regulations or methods agreed upon in advance may compromise the security of personal information or interfere with the normal operation of the Service, NILE may restrict such access or take other necessary protective measures.
④ Specific application methods, procedures, responsible departments, methods of transmission, and other matters relating to requests for transmission of personal information shall be governed by the K-MOOC Privacy Policy or separate guidance.
Article 14 (Notices to Members)
① NILE may notify Members of matters necessary in connection with use of the Service by posting them on K-MOOC, sending an email, providing an in-Service notification, or using another appropriate method.
② Members shall keep their registered email addresses and other contact information up to date so that they can receive notices necessary for use of the Service.
③ NILE shall not be liable for any disadvantage arising from a Member’s failure to receive a notice due to failure to update changed contact information or provision of incorrect contact information, unless such disadvantage is attributable to NILE.
Article 15 (Liability and Limitation of Liability)
① NILE shall endeavor to provide the Service in a stable manner.
② NILE shall not be liable for damages arising without any cause attributable to NILE, and the scope of NILE’s liability in other cases shall be governed by applicable laws and regulations.
③ Where NILE is unable to provide the Service due to a natural disaster, national emergency, failure of an information and communications network or External Service, a sudden increase in Service usage, or any other circumstance that NILE cannot reasonably control, NILE shall not be liable for damages arising therefrom unless such circumstance is attributable to NILE.
④ Unless attributable to NILE, NILE shall not be liable for a User’s failure to obtain the expected benefits from use of the Service.
⑤ Unless attributable to NILE, NILE does not warrant the accuracy, completeness, currency, or fitness for a particular purpose of information, materials, or content provided by a Course Provider, User, or third party.
⑥ Matters relating to the educational content, assessment questions, assessment criteria, educational judgment of instructors, and operation of individual courses shall, in principle, be handled under the responsibility and authority of the relevant Course Provider. However, NILE may take measures as required by applicable laws and regulations or the K-MOOC operating standards, or as necessary for the operation of the platform. The foregoing shall not apply where the relevant matter is attributable to NILE.
⑦ Unless attributable to NILE, NILE shall not be liable for damages arising from a User’s reliance on or use of information or Posts provided by another User or third party.
Article 16 (Termination of the Service Agreement)
① A Member may terminate the service agreement and withdraw from membership through the methods provided by K-MOOC.
② Where necessary to verify the authenticity of a membership withdrawal request or prevent fraudulent withdrawal requests, NILE may request identity verification within a reasonable scope.
③ The processing of personal information and learning-related information after withdrawal from membership shall be governed by applicable laws and regulations and the K-MOOC Privacy Policy.
Article 17 (Governing Law and Jurisdiction)
① These Terms of Use shall be interpreted and applied in accordance with the laws and regulations of the Republic of Korea.
② Where a dispute arises in connection with use of the Service, the competent court shall be determined in accordance with the Civil Procedure Act and other applicable laws and regulations.
